RALEIGH, N.C. – A video of a Raleigh police officer punching a man while attempting to drag him out of a vehicle has gone viral and prompted an investigation. But new video, released by the Raleigh Police Department, shows the moments leading up to the arrest.

The driver in the video, identified as Braily Andres Batista-Concepcion, 22, was arrested on January 15 near Navaho Drive in Raleigh. 

According to The Raleigh Police Department, Batista-Concepcion is responsible for three different hit-and-run incidents.

First they say he struck a vehicle on Wake Forest Road and left the scene. He was then involved in a hit and run in a parking lot at St. Albans Drive and Wake Forest Road, police say. He then reportedly struck a pole on Wingate Drive while fleeing the scene of the second collision.

Police say the suspect vehicle in all three hit and runs matched the vehicle belonging to Batista-Concepcion.

When officers located him and initiated the traffic stop, they say he appeared to be impaired and was uncoorperative. They say he refused to place his hands on the wheel and ignored commands to get out of the vehicle.

Batista-Concepcion is charged with DWI, three counts of Hit and Run, two counts of Contributing to the Delinquency of a Minor, Simple Possession of Marijuana, and Resist, Delay, and Obstruct.

On Thursday, officials announced, following a review of body worn and dash camera video and consulting with the Wake County District Attorney, the SBI will not be asked to investigate the matter.

As is standard practice for all allegations of excessive force however, officials say the Raleigh Police Department Office of Professional Standards will be conducting a criminal investigation and will present their findings to the District Attorney for final review.
