DURHAM, N.C. -- Relatives of DeAndre Ballard, 23, are putting pressure on Durham County District Attorney Satana Deberry to release a statement as to whether or not she'll file charges over student's death.

“We're searching for as much closure as we can get from this,” said Ballard's uncle, Miguel Staten, to Spectrum News Tuesday.

Last September, an unnamed security guard shot and killed the NCCU senior at a Durham apartment complex. The guard told Durham police he acted in self-defense after the two got into a fight. A newly-released autopsy showed Ballard died after getting shot in the arm and abdomen. The medical examiner didn't detect any alcohol in his system. The family doesn't believe the guard's story.

“The family and all of DeAndre's friends know that not to be fact,” added Staten.

To this day, Durham police have neither released the name of the guard nor filed charges. A police spokesperson says Deberry now has the case. Staten believes she's dragging her feet by not publicly releasing a statement on her decision.

“She says she's not willing to release a statement until the mother releases the statement,” said Staten.

Staten says he has spoken with the mother and her distrust in the criminal justice system continues to grow. He's also not sure what Deberry expects the mother to write. He also sent a letter to the city council and mayor expressing his anger that they haven't put pressure on Deberry to release a statement.

Councilman Mark-Anthony Middleton tells Spectrum News that Deberry is an elected official and doesn't answer to the city council. Spectrum News also reached out to Deberry but her office hasn't returned our request for a comment.
