President Trump signed an executive order Thursday to dismantle the Department of Education.
The student loans will be reassigned immediately, the president said.
U.S. District Judge Arun Subramanian set a hearing in the case for Tuesday.
Completing its dismantling is most likely impossible without an act of Congress, which created the department in 1979.
Eliminating the department altogether would be a cumbersome task, which likely would require an act of Congress.

There are 27 charter school locations in Rochester.
