27 year old Danquirs Franklin was shot and killed by Charlotte Police Officer Wende Kerl in a Burger King off Beaties Ford Road.
Officer Kerl was wearing a body camera at the time.
Anyone can petition to get access to the body cam footage but only a Superior Court Judge can decide if the video will be released.
Charlotte Police Chief, Kerr Putney, urged people to think about all the evidence and not just what they can see on the tape when forming an opinion.
Putney said “That is but one piece of a puzzle in a complex investigation. You have witness statement, you have statement of, you have physical evidence. Sometimes we have body worn camera footage and even other camera footage that is in the area of the incident."
A decision is expected April 11.
