We're learning more about the evidence stacked against the woman charged in connection to last fall's double murder in Sodus

Charlene Childers appeared in Wayne County Court Tuesday afternoon to determine whether the statement she provided to police would be admitted. She is accused of second-degree murder and conspiracy in the deaths of Joshua Niles and Amber Washburn.

Prosecutors say after Niles, the father of her two oldest children, won a custody battle, Childers plotted to kill both victims with her husband Timothy Dean and a Texas police chief named Bron Bohlar.

The couple were shot and killed in the driveway of their Sodus home on October 22.

At the hearing, it was revealed that Childers was separated from her husband at the time of the murders and that she was staying at a boyfriends house in Wayne County when a detective called her in for questioning.

Her attorney questioned about whether Childers knew what was happening as she spoke with police during her arrest.

"That question was designed to understand whether Childers was in custody when she engaged with police, or if she was notified of her Miranda rights," said Rome Canzano, Childer's attorney. 

Prosecutors say she met with Wayne County Sheriff's deputies voluntarily and cooperated with the investigation. They also argue that once inconsistent information was provided, she was advised of her rights, but waived them and continued to speak with investigators.

It may be three weeks before Judge Daniel Barrett rules on Childers statement. Attorneys will offer written arguments before that.
