The state Assembly candidate who allegedly stole his opponent's mailer from a homeowner's porch ahead of the election was issued an appearance ticket for petty larceny, a misdemeanor, after turning himself in on Thursday, the Scotia Police Department said Thursday.

A complaint was filed last month with police, alleging Republican Joe Mastroianni, a candidate for New York's 111th Assembly District, stole his opponent's election mailer from a porch in Scotia. A video of the alleged incident was taken off a doorbell camera, and provided to police by the law office of Frank Salamone, the Schenectady County Democratic Committee chair.

Mastroianni was challenging incumbent Assemblyman Angelo Santabarbara, a Democrat.

Scotia police concluded its investigation into the complaint, which "did not uncover any other victims and this appeared to be an isolated incident," Chief Adam Halbfinger said in a statement.

Mastroianni voluntarily turned himself in, Halbfinger said.

Salamone said Thursday that Mastroianni should resign from his seat on the Rotterdam Town Board.

"This is the only charge within the jurisdiction of local police and does not prevent a federal felony charge from being proffered in the future," Salamone said.

Santabarbara defeated Mastroianni 63% to 37% on Tuesday, according to the Schenectady County Board of Elections.

"As this is a legal matter, I will refrain from further comment and trust that the case will move through the criminal justice system appropriately,” Santabarbara said Thursday in a statement.
