ROCHESTER, N.Y. — Suspended Rochester City Court Judge Leticia Astacio is challenging the ruling by the Commission on Judicial Conduct to remove her from the bench.
Astacio's attorney filed an appeal Wednesday asking for a review of the ruling.
The commission announced last month that it was removing the embattled judge from the bench based on several matters of misconduct.
Among those, the Chairman of the commission, Robert Tembeckjian, said Astacio used her position as a judge to avoid the consequences of a DWI conviction.
The commission says she then violated the terms of that sentence, twice.
The matter now moves to the Court of Appeals which will have the final determination.
That decision is expected within the next three to five months.
