The family of a Rochester woman who died after a stay at the Erie County Holding Center has filed a major lawsuit.
An attorney representing the family of India Cummings announced the lawsuit Thursday.
The suit names Erie County, Sheriff Tim Howard, the City of Lackawanna and the city's police department as defendants.
The family says Cummings was arrested by Lackawanna police for allegedly stealing a car in February 2016.
After being held for 16 days, Cummings was pronounced brain dead at a hospital.
The family's attorney claims the Erie County Medical Examiner's Office couldn't determine the cause of death.
He also says an independent expert found holding center staff failed to treat Cummings for severe injuries that led to her death.
Court depositions in the suit included testimony from two former inmates who support that claim.
Erie County and the Sheriff's Office both declined to comment on the lawsuit.
