BUFFALO, N.Y. -- State Supreme Court Justice John Michalek has agreed to resign from his position as an investigation continues into Western New York political operative Steve Pigeon.

Michalek, who pleaded guilty Wednesday to receiving a bribe and false filing, both felonies, will resign as part of that plea agreement.

Michalek read a statement detailing a series of favors he traded with Pigeon. He says he appointed an attorney to a position that the attorney was not qualified for at Pigeon's request, and intentionally defrauded the Office of Court Administration.

Michalek said he also gave non-public information to the political operative. In return, he received kickbacks that include tickets to two Sabres games and a political event, assistance finding two family members jobs and a letter of recommendation for an appellate division position.

If Michalek cooperates with the larger probe going forward, the Attorney General's Office has agreed to take no position on prison time at his sentencing in December. The judge is still free to make his own decision.

The charges carry maximum sentences of seven and four years, respectively, but would be served at the same time.

Pigeon's attorney said he will appear in court Thursday morning.
