CHARLOTTE, N.C. -- Following a deadly and horrific fall from an Uptown Charlotte building under construction, community activists are planning a protest to demand safer conditions for workers.

The Charlotte community of construction workers says 24-year-old Juventino Hernandez will be remembered, and not just as the man who fell to his death. "He was a father to a 4-year-old daughter and a husband," explained Ashley Hawkins, a community organizer with the International Brotherhood of Electrical Workers, local #379.

While it's still under investigation, she says workers are already discussing how Hernandez fell from a 19th floor construction elevator. "The buck hoist dropped causing him to fall out,” Hawkins says. “We've had lots of conflicting stories."

"I worry because this kind of accident can be prevented," Fernandez added. He advocates for Hispanic and Latino construction workers through his organization "Jobs with Justice." "It's a lot of people working but it's not really in safe conditions," Fernandez added.

Fernandez and Hawkins are organizing a protest in front of the 33-story Legacy Union building Wednesday morning at 9:30.

She says the protest is meant to demand more accountability. "We want to see that these contractors and general contractors who have not the best safety records are held accountable for future workers," Hawkins explained.

They also say there is a potentially life threatening lack of training. Before he died, Juventino, Hawkins says, had only been on the job 3 days. "The construction workforce is younger than it was,” Hawkins said. “It’s less trained and we need more training for construction workers."

Fernandez wants the community to know that before work resumes at the site Wednesday. "The workers needs to know his rights,” Fernandez said. “We have the right to work in safe conditions."

That tower is expected to be completed in 2019 and rise 640 feet tall. It will be Charlotte's 4th tallest building.

Spectrum News reached out the company building the Legacy Union site on S. Tryon that Hernandez fell from. They sent this statement:

We are saddened to report that a fatal accident occurred involving a worker at the legacy union construction site. We are gathering information on exactly what happened and have no details to share at this time. We are working closely with authorities who can provide you with more details as they become available. We extend our deepest condolences to all of those affected.

A GoFundMe page has been set up to help Juventino Hernandez's family with funeral expenses.

It's raised more than $7,000 but only had a goal of $5,000.
