SAN ANTONIO - Applications are pouring in for the Bexar County Precinct 2 Constable's position.

  • DA found Vela triggered resign-to-run provision

Last week the district attorney found that Michelle Barrientes Vela triggered the resign-to-run provision of the Texas Constitution when she announced her intention to run for sheriff.

On Monday, she walked that back somewhat and even filed a restraining order against the county. Right now, Bexar County Commissioners will be looking at 29 people for the temporary job.

Over the weekend, Vela's attorney sent a statement saying that during the FBI raid last Monday that she was in shock and she made an excited utterance rather than a formal political declaration to seek the sheriff's seat in 2020.

 

Up until Wednesday, she'll still be able to chip into the nearly $100,000 constable salary. The new person who is appointed will begin getting payments as soon as they can step in.

Also in her emailed statement over the weekend, Vela said she didn't have plans to abandon the four-year seat and that she'd continue to serve the constituents of Precinct 2.

We asked the District Attorney's office about the process of removal and they did not comment because the process is on-going.

A temporary restraining order was issued by a judge, but that does not prevent Commissioners Court from moving forward on selecting the candidates for potential interview and making a selection.

However, they'll have to wait for outcomes of a temporary injunction hearing on October 11.
