DALLAS — A North Texas man is suing Cinemark over alleged false advertising of drink sizes by the Plano-based movie theater company.

Shane Waldorp says he ordered a 24-ounce draft beer at a Cinemark in Grapevine, but when he took it home to check, he found that the cup only holds a maximum 22 ounces. He bought the drink for $8.80, or $9.53 after tax.

In the lawsuit, Waldorp alleges violations of Texas' Deceptive Trade Practices Act, negligent misrepresentation, common law fraud and unjust enrichment.

The lawsuit was filed in federal court on Wednesday in Sherman, north of Dallas. 

Waldorp is seeking financial compensation for the alleged drink shortage and that the company uses cups that hold the same amount of liquid being advertised. 

Waldorp says he’s been “financially injured” by the incident. Cinemark, as of Friday, has not released a public statement concerning the lawsuit.
