SARATOGA SPRINGS, N.Y. -- The Saratoga Springs City Council on Tuesday evening accepted the resignation of a police officer involved in a controversial arrest that was caught on tape.
Officer Nathan Baker was suspended without pay in June after he pepper sprayed a Troy man who gave him the finger.
Adam Rupeka was then pulled over by Baker. Rupeka admits to intentionally provoking Baker as a test to be caught on the video.
After refusing to comply with requests to get out of his car, he was pepper sprayed and arrested, and all of it was posted on the "Capital District Cop Block" Facebook page.
Rupeka was originally charged with resisting arrest, but those charges were dropped.
Full statement from the Saratoga Springs Department of Public Safety:
"The City Council of Saratoga Springs has acted to accept the resignation of Police Officer Nathan Baker from the Saratoga Springs Police Department effective June 4, 2015. At its meeting on July 7, 2015, the City Council voted to approve a separation agreement that accepts his resignation, pays Nathan Baker the sum of $5,000 as payment for his accrued leave time, and resolves any issues relating to his performance as a police officer. The agreement stipulates that Nathan Baker agrees not to apply for a position with the City of Saratoga Springs or its Police Department at any time in the future. With pending potential litigation regarding this matter the City is unable to comment further on Mr. Baker's resignation, or the circumstances leading to his resignation, at this time."
