The Jefferson County Board of Elections says the case of a tie between two Watertown mayoral candidates will go to the State Supreme Court to be decided, because it's a tie and there are no vote discrepancies.
Tthe number of voters are identical to the amount of ballots counted. The only way the supreme court will hear the case is if one of the candidates files a lawsuit to get it there.
The two candidates who remain tied after primaries are Cody Horbacz and Allison Crossman. One of them was supposed to face Jeff Smith, who won the primary.
Without a Supreme Court ruling, none of the three candidates will appear on the November ballot, because the local law never accounted for a tie.
Watertown Mayor Joe Butler has called for a recount, but the board of elections says it will not be doing so because there are no discrepancies.
