The faceoff regarding a referendum for the state takeover of Rochester schools is in the hands of a state Supreme Court judge. 

The city school district filed a lawsuit last week trying to block the city's call for a state takeover of its schools leaving it up to the voters to decide.

In June, city council approved the mayor's request for a referendum and removal of the school board.

"The mayor wants folks to vote. She's very passionate about this subject and she thinks the voice of the voters can only be heard to the extent they show up at the polls so she's very concerned with them voting and she's also very concerned with the health of our school district," said Tim Curtin, City Corporation Council.

"Parents and voters just elected a school board, they just elected a school board, two returning members and two brand new members. From my perspective, the city's move is disrespecting the election that just took place," said Willa Powell, Rochester School Board commissioner.

The judge is expected to make his ruling Friday at 10 a.m.
