ROCHESTER, N.Y. -- Judge Leticia Astacio was taken away in handcuffs Monday afternoon after pleading not guilty on charges of violating her probation.

She is accused of several probation violations, including failing to plug in and register the SCRAM ankle monitor, failing to abstain from consuming alcohol and using products that contain alcohol.

There were also multiple allegations that Astacio made out-of-county trips to places like Del Lago Casino without proper permission from her probation officer.

Her attorney tried to file a request to terminate that probation and also to keep her out of custody Monday.

“She shouldn’t be on probation. She satisfied her original sentence, which was a conditional discharge. And now she’s placed on probation for three years,” said Gregory Salmon, Astacio's attorney.

But Judge Aaronson denied the attorney's requests and sent Astacio to jail without bail.

"This appears to be an individual who I think supervision is good for, I think probation is appropriate. But of course, we reach a certain point where if she isn’t going to comply with the terms and conditions imposed, an alternative may need to be sought. And unfortunately, basically the only alternative we would have at this point would be incarceration,” said Zach Maurer, prosecutor.

Her probation violation hearing is November 3.

“I think we’re going to have to have the hearing, and then the court will decide—if she is found to be in violation—whether or not to continue her probation or impose some other sentence,” said Maurer.

Astacio will return to court Wednesday afternoon to argue for her release.

She continues to collect her more than $170,000 salary.
