GATES, N.Y. — Police say a garbage truck driver involved in a deadly crash in Gates last month had been watching a video on his cell phone while driving.

According to the Gates Police Department, Jerry Moore, 31, of Hamlin has been charged with criminally negligent homicide.

Moore allegedly had his cell phone in a cup holder and was watching a video as his garbage truck rear-ended Paul Laudico last month on Spencerport Road, investigators say.

The 63-year-old Bergen man's car was pushed into another lane where he was hit by a pickup truck and killed.

Police say Moore was issued an appearance ticket and will be back in court on March 30.
