  • The vehicle involved is currently in the custody of the Webster Police Department
  • A 41-year-old female was pronounced dead at the scene

They say Oksana Zakharchishin, 41, was walking to get ice cream at the Abbotts on Empire Boulevard with her daughter Mariana, 22, her other daughter Olesya, 15, and her grandson Maksym Tsybrii, 2, when they were hit by an SUV. Oksana died at the scene.

We're told Olesya is in guarded conditon at the hospital and will need multiple surgeries on a long road to recovery. Mariana and Maksym have been discharged.

Police say the Toyota SUV did not stop after the crash but was located at a home on Fallbrook Circle in Penfield and towed away on Sunday. The SUV is currently in the custody of the Webster Police Department. The driver of the vehicle has also been identified.

Nate Rowan and his girlfriend were on their way home after getting ice cream when they witnessed the crash.

"I think it ended up being 8:50ish. I looked down at my phone. [I] heard a loud crash, very horrific sound that will be hard to erase from my memory," says Rowan. Rowan and his girlfriend got out of the car and noticed a boy in a stroller had been injured. Rowan quickly called 911.

"Honestly, what felt like 20 or 30 minutes was only a 3 minute phone call with 911," says Rowan.

For Rowan, he's hoping the family can get justice.

"I hope that if there's justice to be served that the family can get some sort of closure, whatever that may be because a family member is no longer with them in a very circumstance. And whatever closure that could potentially could bring this family is what i'm thinking about," says Rowan.

The family had just immigrated to Rochester from Ukraine in December. A GoFundMe account has been set up to help the family with funeral expenses.

Police have not commented on what, if any, charges will be filed in the case.
