The case against a Victor Central School District accused of raping a student is being waived to a grand jury.
A court appearance scheduled Tuesday for David Porter, 66, has now been canceled. He is charged with third-degree rape.
Police say the victim is under the age of 17 and is not one of his current students. Authorities say there is an order of protection on behalf of the victim. They add that there is no evidence the assault happened on school grounds.
A joint statement from the school district, the Ontario County Sheriff's Office and the county district attorney says Porter has been placed on immediate leave and work is underway to suspend his teaching certificate. He had submitted plans to retire at the end of this school year.
