A Lyons man who published a threatening social media video, was suspected in an armed robbery in Phelps and the focus of a two-county manhunt in the Finger Lakes has been arrested.
Brandon Burgess, 28, was taken into custody by the Ontario County Sheriff's Office around 11 a.m. Wednesday. Ontario Co. Sheriff Kevin Henderson said Burgess was located following a traffic stop and short foot pursuit in Seneca County. Investigators said he was with another individual, who has not been named or charged.
Paul Kronenwetter said dozens of cop cars lined Lower Lake Road along Cayuga Lake where it happened.
"He surrendered basically and they had him surrounded," Kronenwetter said. "They had him on the ground with a gun at him and he gave up."
Burgess is charged with second-degree robbery and fourth-degree grand larceny. Henderson said Burgess was known to police, but would not comment on if he had a criminal background.
"I was surprised they found him in my back yard here," Kronenwetter said.
Burgess was identified as the person who entered the 7-Eleven at Routes 318 and 14 in Phelps, just off the Geneva exit to the New York State Thruway, and demanded cash around 2:50 a.m. Tuesday. Initially investigators said he was carrying a high capacity long rifle, however, it's since been determined to be an airsoft long gun.
Henderson said Burgess fled the store after the robbery and headed south. Police tried to surround him north of Geneva. By mid-morning Tuesday, Burgess found a vehicle and driven north to Lyons.
Schools in Williamson and Lyons were placed under shelter in place after police reported Burgess headed into Wayne County. Henderson said the Wayne County Sheriff's Office and State Police joined the search around Lyons.
Wayne Co. Sherriff Barry Virts said the lockouts were a precautionary measure.
"I wanted to make sure that if we did encounter that person [Burgess] that no students or residents would be in harms way," Virts said.
By early afternoon, a video of Burgess surfaced on social media. In it, Burgess recorded a threatening message, apparently speaking to a person. In the video, Burgess said, "The hunt is on."
"He didn't hesistate to rob a store and use a weapon, so our concern is what would he do to somebody that may have crossed his path— that was the threat to the public," Henderson added.
The Lyons Central School District closed schools Wednesday. Administrators said it would "allow time for local law enforcement agencies to continue their investigation."
Investigators allege Burgess also stole tools, worth nearly $3,000, from a job site in Phelps Wednesday before he was captured.
Burgess pleaded not guilty to charges during arraignment Wednesday night. The judge deemed him a flight risk and gave a $75,000 cash bail or $150,000 bond.
Burgess is next due back in court Monday at noon in Phelps town court.
The Ontario County District Attorney said he is presenting charges to the grand jury and more could be coming related to the threatening, social media video Burgess put out online.
