The Seneca County Sheriff's Office is looking into why a 2-year-old boy was on his own, and wandered into the road before he was hit by a car on Tuesday. 

It happened in front of Mac's Drive-In on Routes 5 and 20 in Waterloo around 8 p.m. 

Deputies say Leo Butler, 2, suffered critical injuries. He was taken to a Rochester-area hospital, where he remains in guarded condition. 

The boy lives across from the restaurant, according to investigators.

Bethany Arnold, an employee at Mac’s, was there when it happened. She says she knows the family and ran to the road to try to help the child. 

Seneca County Sheriff W. Timothy Luce said Leo's parent, a single mom of four, was not home. 

According to Bethany, the child's 16-year-old sibling was babysitting and nearby when he was struck. 

"It literally was just screeching tires and like a boom," Arnold said. "I feel pain for both, you know, the driver can't imagine what she's going through— everyone else that's in the family."

The 79-year old driver who hit the boy was not charged. She was treated for minor injuries at the scene.
