A federal grand jury has returned a six-count indictment against former Assemblyman Joe Errigo and Albany area lobbyist Robert Scott Gaddy in an alleged case of money being exchanged for state legislation.

Errigo and Gaddy were indicted on conspiracy, taking a bribe over programs receiving federal funds, wire fraud and other charges. Gaddy also faces charges for allegedly agreeing to and paying out a bribe. 

Federal prosecutors say the FBI became aware of Gaddy as it investigated an unidentified re-development project in Rochester. They also looked into his relationship with Errigo.

Investigators asked a third person to eventually approach the two to see if they'd take a bribe to help stop another project in the area with legislation.

Prosecutors say Errigo and Gaddy took the bait, both allegedly accepting several thousand dollars between the fall of 2017 and the winter of 2018. Federal agents said last year that Errigo confessed to taking the bribe.

Gaddy was arraigned in federal court Monday and released on conditions. Errigo will be arraigned on Wednesday morning.

If convicted, Errigo and Gaddy face a maximum sentence of 20 years in prison and a $250,000 fine.
