A judge has denied a motion to vacate the conviction against an Elmira man convicted of first degree gang assault.
Terrance Mack was the only person convicted in connection with the September 2007 death of Latasha Shaw in Rochester.
Mack recently filed a motion claiming he received ineffective assistance of counsel during his 2009 trial.
Judge Christopher Ciaccio issued his ruling this week, denying that motion.
Shaw was killed near the corner of Dewey Avenue and Driving Park after coming to the aid of her then 12-year-old-daughter.
Police say she was beaten and knifed to death during a mob attack. Mack was convicted of hitting Shaw with a bottle.
Mack will continue to serve his sentence of 25 years plus five years of post-release supervision.
