The attorney for Gary Thibodeau argues the court was wrong to ignore new evidence in an effort to have his kidnapping conviction overturned.
Thibodeau is serving 25 years for the disappearance and presumed death of of Heidi Allen in Oswego County. She was last seen in 1994 at the New Haven convenience store where she worked, but her body was never found.
His attorney filed a brief in his appeal this week, claiming Thibodeau was denied due process in his hearing last year. Lisa Peebles argues the court should have considered new evidence that pointed to alternate suspects in Allen's disappearance. She also claims the prosecution intentionally surpressed information that Allen was a confidential informant whose identity had been compromised.
Peebles argues that, taken together, that information would have resulted in a different verdict if presented at Thibodeau's original trial. She's asking the appellate court to overturn the county court's decision and grant Thibodeau a new trial.
