CHARLOTTE, N.Y. -- Police have released the name of the man shot and killed by a Rochester SWAT member during a standoff Monday in Charlotte.

Chief Mike Ciminelli said officers responded to a 911 call reporting a man threatening people with a shotgun just after 4:30 a.m. Monday in the 3700 block of Lake Avenue. Responding officers made contact with the suspect, Phillip Vitullo, 49, of Rochester by phone. He was inside an apartment house.

Shortly after 6 a.m. a pair of shots were fired by Vitullo, according to the chief. Then, just before 9 a.m., police say Vitullo pointed a gun at SWAT officers and Jeremy Nellis, a seven-year veteran of the force, fired a single fatal shot. Vitullo was pronounced dead at the scene. A shotgun has been retrieved at the scene. 

Nellis is on administrative duties while the internal investigation continues.
