ROCHESTER, N.Y. -- Mark Scerbo told the court at his sentencing that there remained nothing he could do or say to stem the grief felt from the loss of Heather Boyum five years ago.

Scerbo was convicted of manslaughter in the July 2012 crash that killed Boyum, a mother and beloved teacher at Fairport, but that conviction was overturned earlier this year. He agreed to a plea deal in August to, in part, spare the Boyum family the pain of a new trial.

"I tend to agree with what Judge (Douglas) Randall said that it's pretty hollow at this point, based on his past," said Eric Boyum, Heather's widower. "I'd hope that he'd prove that but it doesn't hold a lot of weight with me. It's a life-changing event and we'll never be the same as a family."

Scerbo was drunk on his motorcycle, weaving along Route 250 in Penfield, when he hit Boyum on her bicycle. She was thrown into the road and under a car driven by Megan Merkel. Boyum died at the scene.

Scerbo will serve his sentence of seven to 14 years in prison.
