ROCHESTER, N.Y. -- The woman charged in the random killing of an Orleans County mother appeared in court Tuesday.

Holly Colino, 31, faces numerous charges including second degree murder, escaping police custody and weapons charges. 

Investigators say Colino used a pistol to randomly shoot and kill Megan Dix on August 25 in Brockport as Dix sat in her pickup truck during a lunch break.

Upon the defense attorney's request, the judge granted that Colino undergo a competency exam to determine if she is mentally fit to stand trial.

Colino's own family says she suffers from mental health issues. Her family says she was living out of her car between Rochester and Arizona.

"A competency exam is a determination of her mental state right now," defense attorney Mark Foti said. "So what has led up to her current state is something that may be considered, but the examination is related to how she's able to proceed at this particular moment and ultimately the psychiatrists will make a determination as to how far they're going to go back in terms of information to make that decision."

"It's an issue that has come up, it was raised by the defense, the court agrees it needs to be addressed," said prosecutor Julie Hahn. "So that is where we're at with the proceedings and we'll let the proceedings occur in that regard to answer that question."

"You have to be sort of mental anyway to commit a murder," said Donnie Duncanson, the victim's brother. "Let it play out, let justice do it's thing. Hopefully it'll prevail. I still think she was sane enough to get all that stuff, she knew what she was doing coming here. That'll play out."

Colino remains in the Monroe County Jail. She is expected to return to court October 31.
