A day later, the race in the 18th Congressional District is still no closer to being declared, but one candidate — Democratic incumbent Rep. Sean Patrick Maloney — is claiming victory.

"This year is a little different and it’s going take a little longer to get the final result," Maloney said. "But what is clear is that we have won this race. I want to thank my opponents Chele Farley and Scott Smith for the campaigns that they ran."

Latest numbers show Republican candidate Farley behind by just 5,821 votes, with districts in Orange and Dutchess counties, remaining to be counted. Third-party candidate Smith came in behind at just 2,420 votes. Farley is telling Maloney, not so fast.

"I am not conceding,” Farley said. “We still need to count all the ballots. I think that is only fair and just. That is what our system requires. Let’s wait and let’s see what the voters actually decided. These are only preliminary results. Frankly they could change."

Numbers from both counties show a total of 45,800 mail-in ballots yet to be counted. According to Board of Elections numbers, 23,454 of those belong to registered Democrats while 9,340 belong to registered Republicans. Farley said she’s not at all concerned.

"I don’t think we know how these ballots are actually going to count. Right? As a great example, my husband is a registered Democrat," she said. "Rest assured, he voted for me. And I think there are other registered Democrats who are going across party lines."

Maloney said the numbers speak for themselves and he remains resolute in his declaration of victory.

"The nice thing about politics is that it’s like sports. There’s a score. You don’t have to take anybody’s word for it. You can look up at the scoreboard when the clock runs out and you’re going to know," he said. "What I’m telling you is, we won this race decisively."
