A retired Orange County judge is under fire after a lawsuit was filed against him last month under the Child Victims Act.

A Pennsylvania woman is accusing Judge Jeffrey Berry of sexually assaulting her when she was in high school.

The lawsuit filed with the Orange County Court alleges Berry sexually assaulted the plaintiff while she was a student at Cornwall Central High School from 1970 to 1972.

The suit describes how Berry allegedly groomed the victim and how the sexual relationship escalated.

The lawsuit also names the Cornwall Central School District as a defendant, stating that employees were aware of sexual assault allegations against Berry but that he remained employed by the school until he left to attend law school in 1972.

The Cornwall Central School District said they cannot comment on pending legislation. 

A statement from the Orange County executive’s office calls for the retired judge to step down from the county's ethics board.
