The Onondaga County Sheriff’s Office says it will not be complying with ICE requests to detain undocumented immigrants unless an arrest warrant or detainer signed by a judge is received.

Sheriff Toby Shelley cleared up confusion about his office's policy on immigration. He says it is following state and local laws and guidance.

ICE can create an official written request known as a detainer, which asks local law enforcement to continue detaining a person as they consider taking the individual into custody. There's also a judicial warrant, which is signed by a judge and must be legally followed.

The sheriff says his office has worked with ICE on a recent case and will continue following the law to avoid unlawful detentions.
