A second $36 million lawsuit has been filed against Onondaga County, the sheriff's office and members of law enforcement over the two teenagers shot by an Onondaga County sheriff's deputy following a car theft and burglary incident back in September.
This suit was filed by the estate of Dhal Apet, one of the teens killed when a deputy fired three shots at a car heading toward him when attempting to apprehend the teens in the midst of an alleged car theft.
The suit claims the deputy used excessive force and violated Apet's constitutional rights.
Apet, 17, and Lueth Mo, 15, both of Syracuse, the Onondaga County Sheriff's Office says, allegedly attempted to run over Deputy John Rosello following two burglary incidents at smoke shops. A civilian video released by New York Attorney General Letitia James' office shows Rosello attempting to pin a white car in a parking lot and get out of his vehicle. The car then backs into trees, drives between the deputy and his car, and speeds off. Sheriff Toby Shelley said there was no bodycam footage from Rosello, but also expressed his support of the deputy.
