Attorneys representing the gunman sentenced in the Buffalo mass shooting last year have filed a motion that would allow victims' family members and their attorneys access to his cell phone, computer and internet history.

The U.S. Attorney's Office has not yet released this information as a federal case against Payton Gendron is still pending.

"Evidence is powerful. You don't go into a gun fight with a water pistol," said John Elmore, an attorney representing the victims' families. "And all of that information that the government is withholding from us is information that we believe will assist us, prove that other people are responsible for what happened." 

Previously, families and their attornes could only review these items with a member of a defense team present and they could not retain copies or take notes.

Gendron was sentenced to life in prison without the possibility of parole on state charges back in Februrary.
