New York is one step closer to keeping kids' lemonade stands open with the passage of a bill in the Senate Health Committee.
This comes after Brendan Mulvaney, 7, of Ballston Spa had his stand was shut down by the state Department of Health last summer.
Brendan’s stand was set up right outside the Saratoga County Fair back in July. It was shut down when a state health inspector said the boy did not have a permit. He was trying to raise money for a young girl battling a rare bone disease.
The story created outrage around the state.
The bill, sponsored by state Sen. Jim Tedisco, would exempt children 16 years old and younger who operate pop-up lemonade stands with adult supervision from having to obtain and pay for state permits.
The bill is expected to be voted on later this year.
