A Schenectady man pleaded guilty Thursday to conspiring to purchase a shotgun for another individual who allegedly fired it outside of Temple Israel in December, federal law enforcement officials said.
Andrew Miller, 38, of Schenectady, New York, admitted conspiring with Mufid Fawaz Alkhader and lying on an ATF form in saying he was purchasing a Kel-Tec 12-guage pump shotgun from an Albany County firearms dealer, when Alkhader was the actual buyer, according to a statement from the U.S. attorney's office, FBI and ATF.
"Miller and Alkhader came up with the plan because they believed that Alkhader could not lawfully purchase the shotgun himself," federal officials said.
Miller admitted taking possession of the gun and transferring it to Alkhader on Nov. 6, 2023, they said.
Miller faces up to five years in prison and a fine of up to $250,000 when he is sentenced on Oct. 18.
Alkhader is charged with possessing a firearm as a prohibited person and conspiracy to make a false statement during the purchase of a firearm, according to U.S. Attorney Carla Freedman.
The case is being investigated by the FBI’s Joint Terrorism Task Force, the ATF and the Albany Police Department.
