A Tompkins County Sheriff's deputy who was recently fired is now facing charges for a seperate incident at another department.
Kristofer O'Rourke is being charged with a felony criminal sex act and official misconduct. This comes from an investigation into his behavior as an officer with the Geneseo Police Department. State police say the investigation began in August, the same month O'Rourke transferred to the Tompkins County Sheriff's office.
But his time with the Tompkins County Sheriff's office was cut short as he was terminated on the ninth of this month. An internal investigation found a complaint originally filed in Cortland County that O'Rourke allegedly engaged in inappropriate sexual communication with a member of the public while he was on duty.
This incident was sent to the district attorney's office but it was determined it did not rise to the level of a criminal charge. Tompkins County Sheriff's officials say there weren't any disciplinary or performance concerns reported during his background investigation.
