The battle over the 22nd Congressional District race continues.
The district remains without a representative as Republican Claudia Tenney and incumbent Democrat Anthony Brindisi remain locked in a tight battle.
Monday, the judge spoke about thousands of ballots that were submitted to the Oneida County DMV but not processed correctly. Those voters had to submit a provisional affidavit ballot they were given at their polling place.
Lawyers will be back in court Friday to make legal arguments about those ballots. Brindisi's representatives say they remain confident in their case.
Closing arguments are scheduled for January 22.
