Oneida County's former STOP DWI Coordinator was supposed to be in court for arraignment today, but did not show up.

55-year-old Thomas Giruzzi was arrested in Utica in March. A deputy allegedly spotted him driving his personal vehicle while talking on the phone, without a seat belt on, and allegedly in the possession of cocaine.

He's facing two infractions and a misdemeanor.

Giruzzi's lawyer appeared on his behalf in Utica City Court. He says his client plans on pleading not guilty to the three-charges he faces, but cannot make it to court. He hopes to arrange a video conference with the court for arraignment on May 15th.

"Given the location of my client and the issue he's treating, we're going to try to arrange that via Skype or through some type of video conferencing where the court can see my client, my client can see and hear the court, the DA, as well as me, at that time before he can enter a not guilty plea to all counts," said David Longeretta, Giruzzi’s lawyer.

The former Oneida County Probation Director is serving as interim STOP-DWI Coordinator.
