OWASCO, N.Y. - Less than a week after his killer died, a judge has ruled that the family of David Castor Senior will be allowed to remove his remains from the Owasco Rural Cemetery.

David Castor Senior was poisoned and killed by his wife Stacey Castor back in 2005.

Stacey Castor wasn't convicted for the crime until several years later after she attempted to poison her daughter Ashley Wallace.

David Castor was laid to rest next to Stacey's first husband,

Michael Wallace, whose death was shrouded in a cloud of suspicion, David's son will be allowed to exhume is father's remains and destroy the headstone that has Stacey's name on it.
