With former Special Counsel Robert Mueller set to testify Wednesday before the House Judiciary and Intelligence Committees, Rep. Brian Higgins has strong expectations.

“I don’t think Mueller finished his report,” said Higgins, a Buffalo Democrat.

The congressman said he expects the investigator to provide clarity about what he and his team found, specifically on “11 potential likely areas of obstruction of justice” noted in the report. He pointed out one count is an impeachable offense.

“In one area of the report, he makes reference to a Department of Justice memo from 1974 that says you can’t indict a sitting president and then in another area of his report he states that anybody is above the law. Well, which is it?” he asked.

Higgins said Mueller used “ambiguous” and “nebulous” language in his report which left Congress cleaning up. He said the hearings will have two main objectives.

“It’s fulfilling its oversight responsibility, its constitutional responsibility and it’s also finishing what Mueller didn’t finish,” he said. I would say if Mueller didn’t have the stomach to take this on, he shouldn’t have taken it on because he’s left a lot of uncertainty about the conclusions of his report,” he said.
