A judge is considering extending the date for the federal trial of Buffalo mass shooter Payton Gendron.
This comes after defense attorneys argued for an extension to accommodate their replacement attorney.
Last month, Gendron's defense team lost an attorney to an extended illness and had been trying to replace her.
They now tell the court they have found a replacement from California, but she is going to be involved in another case when jury questionnaires begin.
The judge told lawyers he does not believe they need to have the new attorney present for the questionnaire process, but the defense was adamant that the trial begins during jury questionnaires.
At the moment, the trial date is set for January 5.
Gendron is serving a lifetime prison sentence after pleading guilty to state charges in the 2022 shooting that left 10 Black people dead and three injured.
