A judge has ruled that the long proposed AL Asphalt plant in Hamburg can move forward.
The company has been looking to develop and operate a facility on Camp Road since 2019.
The judge says the Hamburg Town Board passed laws that were arbitrarily focused on banning the plant, which he says is illegal. This could now allow the asphalt plant to move forward.
Hamburg Town Supervisor Randy Hoak issued a statement on social media expressing his disappointment, adding that the town board can appeal.
The next town board meeting is planned for September 9.
