Disgraced movie mogul Harvey Weinstein will remain a Western New York prisoner, for now.
He was back before an Erie County Court Judge Friday morning for an extradition hearing again.
Weinstein sat a table in the Wende Correctional Facility in Alden in a maroon button-down shirt. That is where he will remain for at least the next 30 days, as it appears more stall tactics were used to avoid him from being extradited to California.
His attorney referred to Friday’s process as "Groundhog Day" because new paperwork was filed in the case, so the extradition process to Los Angeles is starting over again.
Authorities in California want Weinstein to answer to rape charges involving five women.
Right now, Weinstein is serving a 23-year prison sentence for rape and sexual assault. Because the 69-year-old Weinstein is an inmate in New York, the judge must sign off before he can be transferred.
He has 30 days to contest his arrest, challenge the paperwork or petition Governor Andrew Cuomo to stop him from being sent to Los Angeles. May 30 is the date to note on that.
His attorney plans to file another habeas corpus motion, which challenges a conviction. At that time, there will be another hearing scheduled.
