Another town meeting and still no decision on a proposed asphalt plant in Hamburg.

Both the town board and planning board met Wednesday to go over their options before they make a final decision on the matter.

For months the proposed AL Asphalt Plant on Camp Road has been the subject of major protest by many homeowners because of health concerns, among other things.

The asphalt company is suing the town, claiming improper behavior by the planning board.

Town leaders want to see if they can reach some sort of agreement on the lawsuit first before they make any sort of concrete decision.

They said they don't want to make matters worse.

”What happens next is there will be a return date for the oral argument on the AL Asphalt petition pending on the New York State Supreme Court,” said Hamburg Town Supervisor Jim Shaw. “I think the return date has been adjourned until December 12 but it looks like it may be adjourned even beyond that time. So we may be tied up in litigation for quite some time we'll just have to wait and see.”

Shaw said the town still wants to hear from people who live in the neighborhood so they can make an intelligent decision, making sure taxpayer dollars are spent wisely.
