CHEEKTOWAGA, N.Y. -- As the investigation continues, police in Cheektowaga have released more details about an officer-involved shooting Saturday that ended with the death of a Wyoming County man.
"From what we know now, I don't think there is any question that the officer involved in this occurrence had any choice but to defend himself," said Cheektowaga Police Chief David Zack.
Police say the events that led to Darrell Bosell's deaths started in Wyoming County, where a state trooper was called to a Java residence in Java around 6:15 p.m. Saturday.
"To investigate the theft of not only a .45 caliber rock arms handgun, but also eight rounds in a magazine and additional 30-round box," said Major Steven Nigrelli of New York State Police.
Bosell, 34, was believed to have those items when State Police sent a "Be On the Lookout" alert to law enforcement across Western New York. Troopers made a connection to the Town of Cheektowaga, and called its police department just before 10 p.m. with information about Bosell, requesting their help to locate him.
"Mr. Bosell had been drinking heavily all day. There were concerns about Mr. Bosell's state of mind," said Zack.
Police in Cheektowaga were also given Bosell's cell phone number, and around 10:25 p.m., an officer was able to contact him.
"During that conversation, the officer felt Mr. Bosell was intoxicated and distressed. The officer with whom Mr. Bosell was speaking with is highly trained in dealing with persons in crisis, and is a certified member of our crisis intervention team. Ironically, it would be this very officer who was involved in the fatal encounter," said Zack.
After Bosell's cellphone carrier pinged his phone twice, police determined he rented a room at the Best Western Hotel on Genesee Street. While some officers were inside, around 11 p.m., another arrived in the parking lot.
"It is alleged that Mr. Bosell aggressively approached the officer and directed his handgun at the officer while the officer was still seated in his patrol vehicle," said Zack."The weapon can be seen in Mr. Bosell's right hand, it is clear on the in-car camera recording system. We can definitely see he does face the officer and the handgun comes up in the direction of the officer. That's clear on the video."
Zack said the officer fired two shots, both hitting Bosell in the chest. He believes it was less than 30 seconds from the time the officer arrived until paramedics were called.
"A handgun, believed to be the one reported stolen from the town of Java, was recovered. The handgun was not loaded," said Zack.
While Zack said Bosell wasn't in the video's frame during the entire incident, there is audio of the shooting.
He says the officer involved, who will be identified later in the investigation, is on administrative leave per standard operating procedure. When asked to describe him, Zack said he's very experienced and well-decorated.
"He's one of the best we have. We're very proud of him."
Both Cheektowaga and State Police say their thoughts and prayers are with the Bosell family during this difficult time.
The family attorney, Mason Meyer, released the following statement Monday afternoon:
“On behalf of Mrs. Bosell, her children, and family, we would like to thank the Wyoming County Sheriff’s Department, the Wyoming County Dispatchers, the New York State Police, and the Cheektowaga Police Department for their service and professionalism during this difficult time. We are grateful that no officer was hurt. We pray for the responding officer and his family, that he will be able to return to his job and serve his community soon. The Bosell family needs time to heal and respectfully request their privacy at this time.”
