Two Buffalo residents are suing the New York State Department of Transportation over the project centered around redesigning Route 33.
The proposed $1 billion plan that officials have been talking about for almost two years now would create a tunnel for traffic to travel through near the expressway's current Best Street exit. Then, above ground, there would be a roundabout and green space.
The lawsuit claims the state lacked details in its environmental study and therefore is missing pertinent information about the potential environmental impacts of the tunnel project. The plaintiffs say that not conducting a detailed review violates the state's constitutional green amendment.
Spectrum News 1 has reached out to the state Department of Transportation, but officials there declined to comment on the matter.
