A demolition facility in South Buffalo has been shut down after a two-year battle with the attorney general and neighbors.
The State Supreme Court on Monday ordered Battaglia Demolition to close its doors.
In 2016, New York Attorney General Eric Schneiderman filed a lawsuit against Battaglia, saying the facility was operating without state environmental permits for several years and caused harm to the surrounding community.
The Peabody Street site used to crush concrete and stockpile debris.
The demolition caused dust, debris and odor to float into the Seneca-Babcock neighborhood, creating noise and air pollution.
The case made its way up to State Supreme Court after residents tried to sue the company to address the damages.
“This court decision is a victory for the Seneca-Babcock residents who will no longer be forced to breathe in harmful dust and debris,” Schneiderman said. “As we made clear in court, companies have a fundamental responsibility to comply with state law, and my office won’t hesitate to act to keep New York communities clean, safe and healthy.”
