A Broome County Jail corrections officer is facing charges for allegedly failing to help an inmate suffering from seizures.
A lawsuit filed on behalf of 35-year-old Salladin Barton claims that was he was beaten, abused and denied food at times.
The lawsuit filed in state Supreme Court claims that Barton suffered from underlying conditions that went untreated.
Barton was found unresponsive in his cell in January and later died.
The suit claims that Barton fell off his bed the day he died, and was allowed to lie in a state of unconsciousness for an unreasonable amount of time. Last month three of four toxicology reports came back showing no presence of drugs in Barton's system.
Lawyers have not specified an amount, but the suit is seeking damages from the county and other defendants.
