ROCHESTER, N.Y. -- New evidence heard earlier this year led state Supreme Court Justice Francis Affronti to overturn the murder conviction of Jose Torres.
Torres' attorney, David Abbatoy, confirmed the decision Wednesday evening.
Torres has spent more than 14 years in prison for a murder he claims he didn't commit.
He was convicted in the Fourth of July 2001 death of Miguel Cruz. Convicted killer Angel Carrasquillo testified during the hearing in May to killing Cruz after being robbed of $2,000 worth of heroin.
According to paperwork sent to Time Warner Cable News by Abbatoy, the judge found testimony from other witnesses was newly discovered evidence.
He then ruled, "a probability exists that had such evidence been received at trial it would have raised a reasonable doubt in jurors minds resulting in a verdict more favorable to the defendant."
Moving forward, Abbatoy says the prosecution can choose to appeal, prosecute Torres again or seek to dismiss the charges
"If the prosecutor tries the case again, we'll have to continue to fight just as hard if not hard than we have all along," said Abbatoy. "You know just having a new trial doesn't necessarily make it any easier because there's just another obstacle to clear there. We've cleared one so far."
A spokesperson with the district attorney's office could not comment as they had not received a copy of decision as of Wednesday night.
