ERIE COUNTY, N.Y. -- Tyquan Rivera, who was a young teen when he was convicted of shooting Rochester Police Officer Anthony DiPonzio, is heading back to prison for one year after violating his parole.
The Department of Corrections says Rivera, who was released in July 2016 but had to remain in Erie County, failed to meet curfew and changed his home address without telling his parole officer.
Rivera was 14 in Jan. 2009 when DiPonzio was shot in the head while responding to a call on Dayton Street. Rivera has maintained he did not pull the trigger, even saying in parole board transcripts that "basically they was pinning it on me."
Rivera was convicted of attempted murder and sentenced to 3 1/3rd to 10 years in prison. His conditional release came after he served two-thirds of the maximum sentence.
Anthony DiPonzio returned to desk duty for the RPD after three years of rehabilitation and still works for the department.
