Erie County Sheriff Tim Howard has declared victory in his reelection bid, but Democratic challenger Bernie Tolbert says he is not conceding.

It was a back-and-forth battle for most of the night Tuesday, but with 99 percent of districts reporting, Howard is ahead by 3,850 votes, leading 51-to-49 percent.

If the results stand, Howard would be serving his fourth term. He succeeded Patrick Gallivan back in 2005.

Howard had strong words for critics who called him a racist who discriminated against people and other groups.

"I love honorable people. I love those that believe in personal responsibilities. I don't care what party you come from. I don't care about your race or religion, status or sexual preference or national origin. My commitment remains equal to everyone to protect your safety. This is what I live my life to do," said Howard.

Tolbert released a statement Wednesday afternoon, saying he believes all parties should wait for the official vote certification by the Erie County Board of Elections, which includes tallying absentee and affidavit ballots.
